What Are Hemp Derived Delta 9 Gummies?

All cannabis strains contain Delta 9 THC – even those used for the extraction of CBD. The key thing to understand, though, is that federal law defines two types of cannabis. There’s industrial hemp – which contains no more than 0.3 percent Delta 9 THC by dry weight – and there’s marijuana, which contains more than 0.3 percent Delta 9. How Are Hemp Derived Delta 9 Gummies Legal?

At this point, you might be wondering why it’s important to classify types of cannabis and draw a line of distinction between those types. The 2018 United States Farm Bill is the reason for that distinction. The 2018 Farm Bill removed some cannabis based products from the schedule of controlled substances, paving the way for industrial hemp to be grown nationwide for textiles, building materials, food, and CBD products. The bill defined industrial hemp as cannabis with a Delta 9 THC content no greater than 0.3 percent after drying. Cannabis with a Delta 9 content over 0.3 percent is defined as marijuana and, for now, remains a controlled substance at the federal level.

In addition to legalizing hemp itself, the 2018 Farm Bill also legalized all “derivatives, extracts, cannabinoids, isomers, acids, salts and salts of isomers” derived from industrial hemp.

Hemp derived Delta 9 THC gummies are legal according to current federal law because they are derived from industrial hemp and because their Delta 9 content is below 0.3 percent by dry weight. 

In addition to being legal at the federal level, hemp derived Delta 9 is legal in most states that have no laws specifically mentioning hemp derived Delta 9. Therefore, hemp derived Delta 9 gummies are legal in those states because the federal law applies.

Although hemp derived Delta 9 gummies are legal in most states, some states with recreational or medical cannabis programs have limits in place for how much Delta 9 THC a product can contain per serving.
